    Quiet Communities, Inc. et al. v. United States Environmental Protection Agency et al., Case No. 23-cv-1649 (JMC) — Memorandum opinion and order

    A federal court ruled in 2023 that the EPA had unreasonably delayed for over 40 years in carrying out its legal duties under the Noise Control Act of 1972, which requires the agency to regulate environmental noise, publish noise-related reports, and help state and local governments develop noise control programs. Although President Reagan defunded the EPA's noise office in 1982, Congress never actually repealed the Noise Control Act, meaning the EPA's obligations under the law remained in force. The court granted partial summary judgment in favor of the plaintiffs, finding the EPA's inaction on four key counts unlawful.

    Aircraft Noise Advisory Committee: Notice of Solicitation of Nominations for Membership

    The Federal Aviation Administration (FAA) and Department of Transportation (DOT) are seeking nominations for membership on the Aircraft Noise Advisory Committee (ANAC), a panel established to provide independent advice on aircraft noise exposure and FAA noise policies. The committee will evaluate noise research, explore alternatives to current noise measurement standards, and assess community engagement efforts around airspace changes near airports. As the source for federal transportation grants, the Puget Sound Regional Council was charged with developing a system to meet the growing need for commercial aviation. When the search for a second airport failed, they authorized the Port of Seattle to build the Third Runway, with a mandate to develop a noise abatement and mitigation program. In their effort to stop the Third Runway, the ACC argued over every detail of the Port's efforts--including property buyouts and sound insulation. The dispute was meant to be settled by a three member Expert Arbitration Panel. This is their final report. It finds 2-1, that the Port's program was insufficient in several respects. Despite that, funding for the Third Runway was approved by the PSRC, and the 'Port Package' program, proceeded largely unchanged. Expert Arbitration Panel's final decision finding that the Port of Seattle had not shown sufficient reduction in real on-the-ground noise impacts to satisfy noise reduction conditions required for approval of a third runway at Sea-Tac International Airport. The majority decision concluded the Port's noise abatement programs were insufficient despite being impressive in scope.
