Senate Bill 5652: Reducing Environmental and Health Disparities in Large Port Districts

Washington Senate Bill 5652 requires large port districts, such as the Port of Seattle, to develop and adopt environmental justice implementation plans and community engagement plans by January 1, 2026. These plans must outline how the port will reduce environmental and health disparities in overburdened communities, particularly those affected by aircraft noise, and ensure meaningful participation from vulnerable populations in port decision-making. The bill also mandates compliance with federal civil rights laws and requires the use of screening tools to assess the health and demographic impacts of major port actions valued at $8 million or more.

Senate Bill 5652, introduced by Senator Orwall in Washington State's 69th Legislature during the 2025 Regular Session, proposes reducing environmental and health disparities in large port districts by adding a new chapter to Title 53 RCW. The bill defines key terms including 'qualifying port district' as one authorized to undertake aircraft noise abatement programs under RCW 53.54.010, directly relevant to Sea-Tac Airport noise policy.

Comments on the FAA EA: SAMP Draft Environmental Assessment (Debi Wagner)

This document presents formal public comments opposing an FAA Environmental Assessment for expansion projects at Seattle-Tacoma International Airport. The author argues that the stated justification for expansion is misleading, contending that airport growth would not automatically occur without new gates and terminals since FAA safety rules already cap the number of aircraft operations. Additional concerns raised include disproportionate health burdens on nearby communities, unreliable air pollution modeling, inadequate environmental justice analysis, and failure to properly assess cumulative public health and climate impacts.

City of Tukwila Comment Letter on Sea-Tac Airport Sustainable Airport Master Plan Draft Environmental Assessment

The City of Tukwila submitted formal comments on December 13, 2024, objecting to SeaTac Airport's Sustainable Airport Master Plan Draft Environmental Assessment (SAMP Draft EA), arguing that the study area is too narrow, covering only 3,692 acres, and fails to account for broader impacts on surrounding communities including increased traffic, air quality degradation, and noise under flight paths. The city contends that proposed mitigation measures are inadequate and that the assessment ignores equity and social justice concerns affecting the low-income, diverse communities near the airport. Tukwila is calling for a full Environmental Impact Statement with an expanded General Study Area that includes the entire city and broader South King County region.

Four-City Joint Comment Letter on Seattle-Tacoma International Airport SAMP Draft Environmental Assessment

Four cities near Seattle-Tacoma International Airport — Burien, Normandy Park, SeaTac, and Des Moines — submitted formal comments in December 2024 objecting to the airport's Sustainable Airport Master Plan Environmental Assessment. The cities warn that planned growth will increase annual flight operations by nearly 20% by 2032, expanding the noise impact zone and exposing an estimated 22,000 residents to significant aircraft noise, up from about 14,000 in 2022. They call on the Port of Seattle to extend public review periods, improve its sound insulation program, and take proactive steps to protect the low-income and minority communities most burdened by airport noise.

EPA Region 10 Letter to Port Of Seattle: Review of FAA Draft Environmental Assessment for Sea-Tac Airport SAMP Near Term Projects

The U.S. EPA reviewed the Federal Aviation Administration's draft environmental assessment for Sea-Tac Airport's near-term expansion projects, which include a new second terminal, cargo facilities, and other infrastructure planned through 2032. The EPA raised concerns about disproportionate health and environmental impacts on surrounding communities, noting that air quality indicators such as diesel particulate matter and nitrogen dioxide already exceed the 80th state percentile in the project area. The agency recommends that the final assessment more thoroughly address environmental justice, air quality, climate change, and wetlands impacts on these overburdened neighborhoods.

Council on Environmental Quality Substantially Rewrites NEPA Regulations

In May 2024, the Council on Environmental Quality published major updates to the rules governing how federal agencies must review environmental impacts of projects, affecting everything from public participation to project timelines. The changes place new emphasis on environmental justice, requiring agencies to meaningfully engage communities facing disproportionate environmental burdens, and remove previous rules that limited who could challenge agency decisions in court. While some updates are designed to speed up the review process, others may add new requirements for agencies and project sponsors seeking federal permits or funding.

Environmental Justice Protocol: Seattle-Tacoma International Airport

This document is an Environmental Justice Protocol prepared by Landrum & Brown, Incorporated for the Federal Aviation Administration and the Port of Seattle in June 2024. It addresses socioeconomics, environmental justice, and children's health considerations related to Seattle-Tacoma International Airport. The protocol provides a framework for evaluating how airport-related impacts may affect minority, low-income, and other vulnerable populations in surrounding communities.

NextGen effects on communities surrounding Sea-Tac Airport

This document outlines concerns raised by the Quiet Skies Coalition about how the FAA's NextGen air traffic modernization program has increased flight operations at Seattle-Tacoma International Airport, creating concentrated flight paths over low-income and minority neighborhoods like Burien. It argues that the FAA failed to engage communities before implementing new flight routes, dismissed significant noise and air quality concerns, and has not analyzed the cumulative health impacts of aircraft noise and ultrafine particle emissions on nearby residents. The document also details a successful legal challenge by the City of Burien against the FAA in the 9th Circuit Court of Appeals, which the FAA has continued to ignore.

Issues

Sea-Tac Airport is currently undergoing the largest and longest expansion in its history, collectively known as the Sustainable Airport Master Plan (SAMP). Some of it you can already hear, but you’re probably not aware of what it all means. Here’s what you need to know.

As the source for federal transportation grants, the Puget Sound Regional Council was charged with developing a system to meet the growing need for commercial aviation. When the search for a second airport failed, they authorized the Port of Seattle to build the Third Runway, with a mandate to develop a noise abatement and mitigation program. In their effort to stop the Third Runway, the ACC argued over every detail of the Port's efforts--including property buyouts and sound insulation. The dispute was meant to be settled by a three member Expert Arbitration Panel. This is their final report. It finds 2-1, that the Port's program was insufficient in several respects. Despite that, funding for the Third Runway was approved by the PSRC, and the 'Port Package' program, proceeded largely unchanged. Expert Arbitration Panel's final decision finding that the Port of Seattle had not shown sufficient reduction in real on-the-ground noise impacts to satisfy noise reduction conditions required for approval of a third runway at Sea-Tac International Airport. The majority decision concluded the Port's noise abatement programs were insufficient despite being impressive in scope.
