    Engrossed Substitute Senate Bill 5187

Washington State Engrossed Substitute Senate Bill 5187, passed by both chambers of the legislature on April 23, 2023, is a broad fiscal appropriations act establishing the state budget for the 2023–2025 biennium (July 1, 2023 through June 30, 2025). The bill authorizes funding for salaries, wages, and operating expenses across numerous state agencies and offices, while also amending a wide range of existing state laws related to finance, health, education, and the environment. Note: this document pertains to general Washington State fiscal matters and does not appear to contain specific provisions related to Sea-Tac Airport noise policy.

Engrossed Substitute House Bill 1791: Commercial Aviation Work Group

Washington State's Engrossed Substitute House Bill 1791, passed in 2023, establishes a new 19-member Commercial Aviation Work Group to study the state's long-term airport capacity needs, replacing the earlier Commercial Aviation Coordinating Commission. The bill responds to projections that by 2050, demand for flights in the central Puget Sound region will exceed Seattle-Tacoma International Airport's capacity, and directs the group to explore alternatives—including building or expanding other airports. The legislation acknowledges that any new airport site would carry significant environmental, health, and community impacts requiring decisions from federal, state, and local governments.

SHB 1791 – H AMD 174: Amendment to Modify Intent Statement on Commercial Aviation Facility Impacts and Sea-Tac Alternatives

This 2023 Washington State House amendment (adopted March 8, 2023) updates the intent statement of SHB 1791 to more specifically acknowledge the environmental, health, social, and economic impacts that a major commercial airport can have on surrounding communities. It references a Puget Sound Regional Council study projecting that by 2050, central Puget Sound will face a significant gap between aviation demand and capacity. The amendment emphasizes that exploring alternatives to Seattle-Tacoma International Airport — potentially including new or expanded airports — is critical to meeting future regional transportation needs.

House Bill 1791: Studying the Need for Increased Commercial Aviation Services (Washington State 68th Legislature, 2023)

Washington State House Bill 1791 (2023) establishes a new Commercial Aviation Coordinating Work Group to study the state's long-range aviation needs over the next 20 years, replacing the previous Commercial Aviation Coordinating Commission whose work was disrupted by the COVID-19 pandemic. The 19-member work group, appointed by the governor, will evaluate airport capacity across Washington and assess the potential need for a new commercial airport, taking into account community and environmental impacts. The study is particularly focused on meeting growing aviation demand in western Washington, which has direct implications for how future air traffic and infrastructure decisions may affect communities around Sea-Tac Airport.

Aviation-Impacted Communities Act Draft — Community Board Structure (Page 7, January 2023)

Page 7 of a U.S. House legislative draft (file g:WHLC1052310523.058.xml, dated January 5, 2023) covering Sections 4–5 of what appears to be the Sen/Rep Smith aviation noise bill (SMITWA). The text establishes that designated aviation-impacted communities must, within 6 months, select a community board equally representing elected officials, local airport operators, impacted residents, and public health and environment interests.

Final Bill Report ESHB 1791: Studying the Need for Increased Commercial Aviation Services

Washington State's ESHB 1791 replaces the Commercial Aviation Coordinating Commission with a new Commercial Aviation Work Group tasked with studying the long-range commercial aviation needs of the state, including evaluating potential sites for new or expanded airports. The Work Group must consider environmental impacts, greenhouse gas emissions, water quality, and compatibility with military installations, while excluding expansion of airports in counties with populations of 2 million or more residents — effectively ruling out major expansion at Sea-Tac. The group is required to submit annual progress reports to the Governor and the Legislature's Transportation Committees.

    Overview of the legislative process

This document provides an overview of how Washington State's Legislature turns ideas into laws, walking through each step from a bill's introduction and committee review to floor votes, the Governor's signature, and final enactment. It explains the roles of the Senate and House of Representatives across Washington's 49 legislative districts, the structure of regular and special sessions, and how bills can carry over within a two-year legislative cycle. While focused on general legislative procedure, this resource may provide context for understanding how noise-related policies affecting areas like Sea-Tac Airport are formally proposed, debated, and passed into state law.

Engrossed Second Substitute Senate Bill 5141: Environmental Justice—Various Provisions (HEAL Act)

Washington State's Engrossed Second Substitute Senate Bill 5141, signed into law in May 2021, aims to reduce environmental and health disparities by implementing recommendations from the state's Environmental Justice Task Force. The law requires covered state agencies—including the departments of ecology, health, transportation, and others—to address the disproportionate environmental burdens faced by low-income communities and communities of color. It establishes an Environmental Justice Council and directs state programs to prioritize benefits for communities with the greatest environmental and health burdens.

E2SSB 5141: House Bill Analysis — Reducing Environmental and Health Disparities (HEAL Act)

Washington State Senate Bill 5141 requires several state agencies, including the departments of Ecology, Health, Transportation, and others, to incorporate environmental justice principles into their planning and decision-making processes. The bill mandates that these agencies complete environmental justice assessments for significant actions, create community engagement plans for overburdened communities, and consult with Indian tribes on decisions affecting tribal lands. An environmental justice council would be established to oversee implementation, and the Department of Health would maintain an environmental health disparities map tracking conditions across Washington communities.

As the source for federal transportation grants, the Puget Sound Regional Council was charged with developing a system to meet the growing need for commercial aviation. When the search for a second airport failed, they authorized the Port of Seattle to build the Third Runway, with a mandate to develop a noise abatement and mitigation program. In their effort to stop the Third Runway, the ACC argued over every detail of the Port's efforts--including property buyouts and sound insulation. The dispute was meant to be settled by a three member Expert Arbitration Panel. This is their final report. It finds 2-1, that the Port's program was insufficient in several respects. Despite that, funding for the Third Runway was approved by the PSRC, and the 'Port Package' program, proceeded largely unchanged. Expert Arbitration Panel's final decision finding that the Port of Seattle had not shown sufficient reduction in real on-the-ground noise impacts to satisfy noise reduction conditions required for approval of a third runway at Sea-Tac International Airport. The majority decision concluded the Port's noise abatement programs were insufficient despite being impressive in scope.
