EXH 300: Third Declaration Paul S. Fendt — ACC v. Ecology, PCHB No. 01-160

This legal declaration by stormwater engineer Paul S. Fendt, filed before Washington's Pollution Control Hearings Board, addresses the Port of Seattle's Master Plan Update and its potential impacts on local stream flows in Miller, Walker, and Des Moines Creeks near Sea-Tac Airport. Fendt explains the use of the HSPF hydrologic model and a 2-year, 7-day low flow standard to assess and mitigate summer streamflow impacts resulting from planned airport expansion projects. He concludes that revised analysis shows no significant changes to previously calculated low flow impacts.

EXH 247: Northwest Hydraulic Consultants Letter to Army Corps — STIA Third Runway Low Flow Mitigation Deficiencies

A November 2001 letter from Northwest Hydraulic Consultants, written on behalf of the Airport Communities Coalition, raises serious technical objections to the Port of Seattle's proposed plan to manage low streamflow impacts from SeaTac Airport's third runway construction on Miller, Walker, and Des Moines Creeks. The letter argues that the Port's analysis contains critical flaws, including an incorrect assumption that virtually all runway runoff infiltrates into adjacent grassed filter strips, and that the use of hourly rather than shorter time intervals in hydrological modeling causes stream impacts to be underestimated and mitigation storage facilities to be undersized. The consultants also express concern that the Port was not adequately addressing outstanding public comments or certification requirements set by regulatory agencies such as the Washington Department of Ecology.

Port Of Seattle’s response to Airport Communities Coalition (ACC) motion to supplement the record in PCHB Case No. 01-160, filed November 26, 2001. Port argues ACC’s hearsay emails and Keith Smith letter regarding revisions to the Low Streamflow Analysis do not warrant supplementing the record on the motion to stay. As the source for federal transportation grants, the Puget Sound Regional Council was charged with developing a system to meet the growing need for commercial aviation. When the search for a second airport failed, they authorized the Port of Seattle to build the Third Runway, with a mandate to develop a noise abatement and mitigation program. In their effort to stop the Third Runway, the ACC argued over every detail of the Port's efforts--including property buyouts and sound insulation. The dispute was meant to be settled by a three member Expert Arbitration Panel. This is their final report. It finds 2-1, that the Port's program was insufficient in several respects. Despite that, funding for the Third Runway was approved by the PSRC, and the 'Port Package' program, proceeded largely unchanged. Expert Arbitration Panel's final decision finding that the Port of Seattle had not shown sufficient reduction in real on-the-ground noise impacts to satisfy noise reduction conditions required for approval of a third runway at Sea-Tac International Airport. The majority decision concluded the Port's noise abatement programs were insufficient despite being impressive in scope.
