RE: Airport Improvement Program compliance requirements

In 2015, FAA officials exchanged emails explaining how federal Airport Improvement Program grant funds were used to replace the Olympic Elementary School in the Highline School District near Seattle-Tacoma International Airport. Because Olympic fell within the airport's 65 DNL noise zone but was deemed not worth insulating, the FAA allowed approximately $3.9 million in noise-mitigation funds to offset construction of the new Marvista Elementary School instead. The exchange was prompted by a Washington State Auditor inquiry questioning whether Davis-Bacon Act and other federal compliance requirements applied, given that the grant was awarded after the construction project had already been completed.

RE: Highline School District – Olympic payment

In July 2014, the FAA approved a final grant payment of $3,879,406 to the Port of Seattle for noise mitigation work completed at Olympic Elementary School near Seattle-Tacoma International Airport. The total project cost was approximately $11.36 million, funded through a combination of FAA Airport Improvement Program (AIP) grants, Airport Development Fund (ADF) contributions, and Ad Valorem Tax revenues. Port of Seattle Airport Noise Programs Manager Stan Shepherd notified the treasury department of the approved funds and requested confirmation of availability to issue full payment to the school district.

As the source for federal transportation grants, the Puget Sound Regional Council was charged with developing a system to meet the growing need for commercial aviation. When the search for a second airport failed, they authorized the Port of Seattle to build the Third Runway, with a mandate to develop a noise abatement and mitigation program. In their effort to stop the Third Runway, the ACC argued over every detail of the Port's efforts--including property buyouts and sound insulation. The dispute was meant to be settled by a three member Expert Arbitration Panel. This is their final report. It finds 2-1, that the Port's program was insufficient in several respects. Despite that, funding for the Third Runway was approved by the PSRC, and the 'Port Package' program, proceeded largely unchanged. Expert Arbitration Panel's final decision finding that the Port of Seattle had not shown sufficient reduction in real on-the-ground noise impacts to satisfy noise reduction conditions required for approval of a third runway at Sea-Tac International Airport. The majority decision concluded the Port's noise abatement programs were insufficient despite being impressive in scope.
