Exhibit 227: Port Of Seattle’s First Set of Interrogatories and Requests for Production to ACC, with Answers and Responses — PCHB No. 01-160

This document contains legal discovery materials from a Pollution Control Hearings Board case in Washington State, in which the Airport Communities Coalition (ACC) challenged the Port of Seattle and the Washington Department of Ecology over the Sea-Tac Third Runway Project. The Port of Seattle submitted interrogatories asking ACC to identify its expert witnesses and their prior testimony histories, to which ACC objected as overbroad and burdensome. Expert witnesses from Northwest Hydraulic Consultants, including Bill Rozeboom and Malcolm Leytham, are listed along with their prior cases involving stormwater and water quality issues relevant to the runway project.

EXH 458: Review Comments Low Streamflow Analysis – Summer Low Flow Impact Offset Facility Proposal, Dec 2001

This February 2002 draft document from King County Department of Natural Resources presents technical review comments on the Port of Seattle's December 2001 Low Streamflow Analysis and Summer Low Flow Impact Offset Facility Proposal. The review identifies several deficiencies in the hydrologic modeling for Walker Creek and Miller Creek, including inconsistencies in impervious area calculations, questionable vault-filling timelines, and concerns about the accuracy of observed streamflow data used for calibration. King County recommends additional refinements before approving the revised impact numbers, and suggests that Ecology and the Port establish a formal compliance oversight process.

Issues

Sea-Tac Airport is currently undergoing the largest and longest expansion in its history, collectively known as the Sustainable Airport Master Plan (SAMP). Some of it you can already hear, but you’re probably not aware of what it all means. Here’s what you need to know.

As the source for federal transportation grants, the Puget Sound Regional Council was charged with developing a system to meet the growing need for commercial aviation. When the search for a second airport failed, they authorized the Port of Seattle to build the Third Runway, with a mandate to develop a noise abatement and mitigation program. In their effort to stop the Third Runway, the ACC argued over every detail of the Port's efforts--including property buyouts and sound insulation. The dispute was meant to be settled by a three member Expert Arbitration Panel. This is their final report. It finds 2-1, that the Port's program was insufficient in several respects. Despite that, funding for the Third Runway was approved by the PSRC, and the 'Port Package' program, proceeded largely unchanged. Expert Arbitration Panel's final decision finding that the Port of Seattle had not shown sufficient reduction in real on-the-ground noise impacts to satisfy noise reduction conditions required for approval of a third runway at Sea-Tac International Airport. The majority decision concluded the Port's noise abatement programs were insufficient despite being impressive in scope.
