EXH 296: Declaration Paul S. Fendt — Stormwater Mgmt & Low Flow Mitigation, PCHB 01-133

This declaration by stormwater engineer Paul S. Fendt, filed in a Washington State Pollution Control Hearings Board case, explains how Sea-Tac International Airport's Master Plan Update will increase impervious surfaces and alter stormwater runoff into Miller, Walker, and Des Moines Creeks. The document outlines mitigation measures, including 344.1 acre-feet of new detention storage and controlled low-flow water releases, to offset increased peak flows and reduced summer stream flows caused by airport expansion. It provides technical background on the affected watersheds and the Port of Seattle's stormwater management strategy.

Chronology of Section 401 permit, second application

This document chronicles the Port of Seattle's second Section 401 Clean Water Act permit application, submitted in September 1999, which was on the verge of being denied by the Washington State Department of Ecology due to multiple shortcomings related to wetlands and water quality. On September 28, 2000, a private, unannounced meeting was held between Port, Ecology, and Governor's office officials, after which the Port strategically withdrew its application to avoid a formal denial. A series of closed-door negotiating sessions followed in October 2000, none of which were publicly announced, raising concerns about political influence and lack of transparency in the permitting process for Sea-Tac Airport expansion.

Issues

Sea-Tac Airport is currently undergoing the largest and longest expansion in its history, collectively known as the Sustainable Airport Master Plan (SAMP). Some of it you can already hear, but you’re probably not aware of what it all means. Here’s what you need to know.

As the source for federal transportation grants, the Puget Sound Regional Council was charged with developing a system to meet the growing need for commercial aviation. When the search for a second airport failed, they authorized the Port of Seattle to build the Third Runway, with a mandate to develop a noise abatement and mitigation program. In their effort to stop the Third Runway, the ACC argued over every detail of the Port's efforts--including property buyouts and sound insulation. The dispute was meant to be settled by a three member Expert Arbitration Panel. This is their final report. It finds 2-1, that the Port's program was insufficient in several respects. Despite that, funding for the Third Runway was approved by the PSRC, and the 'Port Package' program, proceeded largely unchanged. Expert Arbitration Panel's final decision finding that the Port of Seattle had not shown sufficient reduction in real on-the-ground noise impacts to satisfy noise reduction conditions required for approval of a third runway at Sea-Tac International Airport. The majority decision concluded the Port's noise abatement programs were insufficient despite being impressive in scope.
