EXH AR023559: Letter Water Resources Consulting (Peter Willing PhD) re SEPA DNS Sea-Tac Aircraft Hydrant Fueling System

In a October 2000 letter to the Port of Seattle, Water Resources Consulting LLC — writing on behalf of the Airport Communities Coalition — raised concerns about the SeaTac Aircraft Hydrant Fueling System project, arguing that construction should be delayed until an ongoing groundwater contamination study under the Model Toxics Control Act was completed. The letter criticized the project's environmental review (Declaration of Nonsignificance) for lacking specific details about leak detection, operating pressures, and contaminated soil management. The consultant warned that deep utility trenching could create preferential flow paths for existing fuel contaminant plumes, potentially threatening the groundwater supplies relied upon by nearby communities.

EXH AR023911: Email Luster to Ecology Staff – STIA 401 Certification Requirements & Minority Opinion

In an October 18, 2000 email, Tom Luster of Washington State Department of Ecology shares his draft notes from a discussion about what the Port of Seattle and Ecology must do to meet Section 401 water quality certification requirements related to Sea-Tac Airport. Luster acknowledges that his views represent a minority opinion within the group, but argues his written notes may be clearer than his verbal explanations and could help prepare the agency to respond to similar questions likely to arise during public review. He expresses hope that sharing these notes will help the team reach a legally defensible decision on the 401 certification.

As the source for federal transportation grants, the Puget Sound Regional Council was charged with developing a system to meet the growing need for commercial aviation. When the search for a second airport failed, they authorized the Port of Seattle to build the Third Runway, with a mandate to develop a noise abatement and mitigation program. In their effort to stop the Third Runway, the ACC argued over every detail of the Port's efforts--including property buyouts and sound insulation. The dispute was meant to be settled by a three member Expert Arbitration Panel. This is their final report. It finds 2-1, that the Port's program was insufficient in several respects. Despite that, funding for the Third Runway was approved by the PSRC, and the 'Port Package' program, proceeded largely unchanged. Expert Arbitration Panel's final decision finding that the Port of Seattle had not shown sufficient reduction in real on-the-ground noise impacts to satisfy noise reduction conditions required for approval of a third runway at Sea-Tac International Airport. The majority decision concluded the Port's noise abatement programs were insufficient despite being impressive in scope.
