Senate bill report SB 5955: Mitigating harm and improving equity in large port districts

Washington Senate Bill 5955 proposes creating a 'port district equity fund' to help large port districts—such as the one operating Sea-Tac Airport—pay for aircraft noise mitigation programs. The fund would be seeded with a $10 million appropriation for fiscal year 2025 and subsequently replenished by sales and use tax revenue collected on capital construction projects at the airport, with the port district required to match at least half of state-provided funds. The Department of Commerce would administer grants from the fund to cover costs such as inspecting and repairing soundproofing equipment in nearby homes and addressing any structural damage caused by its installation.

PSSB 5955 – Mitigating harm and improving equity in large port districts

Washington State Senate Bill 5955 creates a 'port district equity fund' to help large port districts, such as the Port of Seattle operating Sea-Tac International Airport, pay for aircraft noise mitigation programs in nearby communities. The bill provides an initial one-time appropriation for FY 2025, followed by ongoing funding of up to $10 million per year drawn from sales and use taxes on capital construction projects within the district. It also requires port districts to apply for fund resources to repair or replace noise mitigation equipment that is no longer working or has caused structural damage to properties, with port districts required to match at least half of the Legislature's contribution.

HB 2070: Bill Analysis — Integrating Environmental Justice Considerations into Certain Project Decisions

Washington State House Bill 2070 requires government agencies to complete environmental justice impact statements alongside standard environmental reviews for new, expanding, or permit-renewing projects located in pollution-burdened communities. The bill outlines what these statements must include, how affected communities must be notified and given input, and mandates that agencies deny or require mitigation for projects that would worsen environmental or public health conditions in already overburdened areas. Note that this bill addresses broad statewide environmental justice policy and does not specifically pertain to Sea-Tac Airport noise issues.

Senate bill report SB 5955: Mitigating harm and improving equity in large port districts

Washington Senate Bill 5955 would require large port districts operating airports with more than 900 daily flights — such as Sea-Tac — to launch a remedial mitigation program addressing failed soundproofing, air quality, green space, and community facilities in noise-impacted neighborhoods. The bill would fund these programs through a portion of the port's annual property tax levy revenue and establish a state environmental equity fund, managed by the Department of Commerce, to provide grants and loans to qualifying ports. Property owners within ten miles of the airport experiencing 55 decibels or more of aircraft noise would be eligible for free inspections and mitigation equipment, with priority given to homes where previously installed soundproofing has failed.

As the source for federal transportation grants, the Puget Sound Regional Council was charged with developing a system to meet the growing need for commercial aviation. When the search for a second airport failed, they authorized the Port of Seattle to build the Third Runway, with a mandate to develop a noise abatement and mitigation program. In their effort to stop the Third Runway, the ACC argued over every detail of the Port's efforts--including property buyouts and sound insulation. The dispute was meant to be settled by a three member Expert Arbitration Panel. This is their final report. It finds 2-1, that the Port's program was insufficient in several respects. Despite that, funding for the Third Runway was approved by the PSRC, and the 'Port Package' program, proceeded largely unchanged. Expert Arbitration Panel's final decision finding that the Port of Seattle had not shown sufficient reduction in real on-the-ground noise impacts to satisfy noise reduction conditions required for approval of a third runway at Sea-Tac International Airport. The majority decision concluded the Port's noise abatement programs were insufficient despite being impressive in scope.
