EXH AR023887: WA Dept of Ecology SEA/NWRO Environmental Programs Monthly RP Aug 2001

In August 2001, Washington State's Department of Ecology issued a 401 water quality certification to the Port of Seattle for the proposed SeaTac Third Runway, permitting construction of an 8,500-foot parallel runway involving fill of nearly 20 acres of wetlands and development of 700 acres of upland area. The certification imposed strict stormwater management and wetland mitigation conditions, including 201 acres of wetland creation and riparian restoration. The certification was subsequently appealed by the Airport Communities Coalition on August 23, 2001, with a hearing before the Pollution Control Hearings Board scheduled for March 2002.

Exhibit 429: Annual Stormwater Monitoring Report for Seattle-Tacoma International Airport, July 1, 2000 through June 30, 2001

This report, prepared by the Port of Seattle in September 2001, presents the findings of annual stormwater monitoring conducted at Seattle-Tacoma International Airport for the period July 1, 2000 through June 30, 2001. It covers water quality sampling results for pollutants including petroleum hydrocarbons, fecal coliforms, suspended solids, metals, and deicing-related contaminants collected from the airport's storm drainage system. The report documents sampling locations, storm events analyzed, and outfall inspections aimed at assessing the airport's environmental impact on surrounding waterways.

EXH AR026646: Response to Comment #16 — Fish Tissue Screening Concentrations Lead, Zinc, Copper, Miller Creek Cutthroat Trout

This technical memo evaluates whether lead and zinc levels found in cutthroat trout from Miller Creek pose a risk, arguing that standard tissue screening concentrations are not appropriate for trout. Using fish-specific toxicity data and bioconcentration factors, the authors derive alternative thresholds and conclude that measured metal levels in the trout fall well below harmful concentrations. The document recommends using species-specific methods rather than generic screening values when assessing metal risks to fish.

EXH AR021073: Declaration Greg Wingard Supporting ACC Motion for Stay PCHB 01-133 01-160

This legal declaration, filed before Washington State's Pollution Control Hearings Board, was submitted by environmental consultant Greg Wingard in support of the Airport Communities Coalition's motion to stay a Section 401 water quality certification related to Sea-Tac International Airport. Wingard details his extensive review of the airport's NPDES stormwater permits since 1994 and describes his attempts to obtain construction outfall monitoring records from the Department of Ecology through Public Disclosure Act requests. His investigation found that Ecology lacked key monitoring data it had previously claimed to possess, directing him instead to contact the Port of Seattle directly for the records.

EXH AR024536: Findings of Fact, Conclusions of Law & Order — Port of Seattle v. RST Enterprises & King County (No. 99-2-26788-5 KNT)

In 2001, the King County Superior Court issued findings of fact and conclusions of law in an eminent domain case where the Port of Seattle condemned a 2.44-acre parcel (Parcel 92) at 15416 Des Moines Memorial Drive in SeaTac to support its Third Runway project, using the land as a flood plain. The property, owned by RST Enterprises and zoned single-family residential (UL-7200), had been used for farming for at least 50 years and fell near the 65-70 LDN aircraft noise contours, making residential financing difficult. The court found that while a commercial rezone was possible long-term, it was not reasonably likely in the near future and would only have occurred due to the presence of the Third Runway.

Issues

Sea-Tac Airport is currently undergoing the largest and longest expansion in its history, collectively known as the Sustainable Airport Master Plan (SAMP). Some of it you can already hear, but you’re probably not aware of what it all means. Here’s what you need to know.

As the source for federal transportation grants, the Puget Sound Regional Council was charged with developing a system to meet the growing need for commercial aviation. When the search for a second airport failed, they authorized the Port of Seattle to build the Third Runway, with a mandate to develop a noise abatement and mitigation program. In their effort to stop the Third Runway, the ACC argued over every detail of the Port's efforts--including property buyouts and sound insulation. The dispute was meant to be settled by a three member Expert Arbitration Panel. This is their final report. It finds 2-1, that the Port's program was insufficient in several respects. Despite that, funding for the Third Runway was approved by the PSRC, and the 'Port Package' program, proceeded largely unchanged. Expert Arbitration Panel's final decision finding that the Port of Seattle had not shown sufficient reduction in real on-the-ground noise impacts to satisfy noise reduction conditions required for approval of a third runway at Sea-Tac International Airport. The majority decision concluded the Port's noise abatement programs were insufficient despite being impressive in scope.
