    EXH 277: Email Chain – Proposed Language Condition E(1)(b) Third Runway Fill Criteria SPLP Testing Drainage Layer Cover

    In September 2001, representatives from the Port of Seattle and the Washington Attorney General's office exchanged emails negotiating the language of Condition E(1)(b), which governs fill material criteria for an embankment construction project. The proposed language would allow the Port to use a 'drainage layer cover' design and to demonstrate fill suitability through Synthetic Precipitation Leaching Procedure (SPLP) testing as an alternative to standard fill limitations. Under the proposal, SPLP test results would be submitted to the Washington Department of Ecology at least ten business days before any fill placement.

    EXH AR023887: WA Dept of Ecology SEA/NWRO Environmental Programs Monthly RP Aug 2001

    In August 2001, Washington State's Department of Ecology issued a 401 water quality certification to the Port of Seattle for the proposed SeaTac Third Runway, permitting construction of an 8,500-foot parallel runway involving fill of nearly 20 acres of wetlands and development of 700 acres of upland area. The certification imposed strict stormwater management and wetland mitigation conditions, including 201 acres of wetland creation and riparian restoration. The certification was subsequently appealed by the Airport Communities Coalition on August 23, 2001, with a hearing before the Pollution Control Hearings Board scheduled for March 2002.

    EXH AR024536: Findings of Fact, Conclusions of Law & Order — Port of Seattle v. RST Enterprises & King County (No. 99-2-26788-5 KNT)

    In 2001, the King County Superior Court issued findings of fact and conclusions of law in an eminent domain case where the Port of Seattle condemned a 2.44-acre parcel (Parcel 92) at 15416 Des Moines Memorial Drive in SeaTac to support its Third Runway project, using the land as a flood plain. The property, owned by RST Enterprises and zoned single-family residential (UL-7200), had been used for farming for at least 50 years and fell near the 65-70 LDN aircraft noise contours, making residential financing difficult. The court found that while a commercial rezone was possible long-term, it was not reasonably likely in the near future and would only have occurred due to the presence of the Third Runway.

    The Airport Communities Coalition (ACC) — representing the cities of Burien, Des Moines, Federal Way, Normandy Park, and Tukwila, plus the Highline School District — filed a formal appeal in August 2001 challenging Washington State's approval of environmental permits for Seattle-Tacoma International Airport's proposed third runway. The appeal targets the Department of Ecology's Clean Water Act Section 401 Certification and Coastal Zone Management Act concurrency statement, both issued on August 10, 2001. ACC argued that the Port of Seattle's application contained scientific flaws and insufficient information to protect local waterways such as Des Moines Creek and Miller Creek that run through the surrounding communities.

As the source for federal transportation grants, the Puget Sound Regional Council was charged with developing a system to meet the growing need for commercial aviation. When the search for a second airport failed, they authorized the Port of Seattle to build the Third Runway, with a mandate to develop a noise abatement and mitigation program. In their effort to stop the Third Runway, the ACC argued over every detail of the Port's efforts--including property buyouts and sound insulation. The dispute was meant to be settled by a three member Expert Arbitration Panel. This is their final report. It finds 2-1, that the Port's program was insufficient in several respects. Despite that, funding for the Third Runway was approved by the PSRC, and the 'Port Package' program, proceeded largely unchanged. Expert Arbitration Panel's final decision finding that the Port of Seattle had not shown sufficient reduction in real on-the-ground noise impacts to satisfy noise reduction conditions required for approval of a third runway at Sea-Tac International Airport. The majority decision concluded the Port's noise abatement programs were insufficient despite being impressive in scope.
