EXH 462: Phone Call Notes — ACC Appeals WDOE Third Runway Permit, King County Role

A September 18, 2001 phone call memo from Ann Kenny of the Washington Department of Ecology (WDOE) outlines a legal dispute over the 3rd Runway permit at Sea-Tac Airport, in which the Airport Communities Coalition (ACC) filed a Motion for Stay claiming an imminent environmental threat. WDOE attorneys requested King County provide technical rebuttals to the ACC's expert statements by October 1, 2001, but King County lacked the necessary documents, a contract amendment, and adequate time to respond. WDOE warned it might subpoena County staff if they did not commit to providing the requested support.

EXH AR023891: Contract Amendment Request — King County Review Services, Ecology Third Runway Permit Appeal

This document is an email chain from September 2001 in which King County's David Masters notifies Ann Kenny that spending on a contract for technical review services provided to the Washington State Department of Ecology has exceeded its $95,000 limit by $23,695. Masters proposes amending the contract to increase the budget by $170,000 to a new total of $265,000, covering anticipated work such as low-flow analysis, preparation of appeal materials, and potential expert witness testimony. Ann Kenny forwarded the information to Michael Cheyne to facilitate the contract amendment process.

As the source for federal transportation grants, the Puget Sound Regional Council was charged with developing a system to meet the growing need for commercial aviation. When the search for a second airport failed, they authorized the Port of Seattle to build the Third Runway, with a mandate to develop a noise abatement and mitigation program. In their effort to stop the Third Runway, the ACC argued over every detail of the Port's efforts--including property buyouts and sound insulation. The dispute was meant to be settled by a three member Expert Arbitration Panel. This is their final report. It finds 2-1, that the Port's program was insufficient in several respects. Despite that, funding for the Third Runway was approved by the PSRC, and the 'Port Package' program, proceeded largely unchanged. Expert Arbitration Panel's final decision finding that the Port of Seattle had not shown sufficient reduction in real on-the-ground noise impacts to satisfy noise reduction conditions required for approval of a third runway at Sea-Tac International Airport. The majority decision concluded the Port's noise abatement programs were insufficient despite being impressive in scope.
