Exhibit 2239: List of Submittals Received from Port Of Seattle Regarding Agreed Order #97TC-N122

Memo dated September 20, 2001 from Roger Nye, Ecology Toxics Cleanup Program (Northwest Regional Office), to Colleen D. Bradford, Assistant State Auditor, listing eight work product submittals received from Port Of Seattle under Agreed Order #97TC-N122 (finalized May 1999). Submittals span June 1999 through October 2000 and include conceptual hydrogeological flow model presentations, Excel spreadsheet

EXH 277: Email Chain – Proposed Language Condition E(1)(b) Third Runway Fill Criteria SPLP Testing Drainage Layer Cover

In September 2001, representatives from the Port of Seattle and the Washington Attorney General's office exchanged emails negotiating the language of Condition E(1)(b), which governs fill material criteria for an embankment construction project. The proposed language would allow the Port to use a 'drainage layer cover' design and to demonstrate fill suitability through Synthetic Precipitation Leaching Procedure (SPLP) testing as an alternative to standard fill limitations. Under the proposal, SPLP test results would be submitted to the Washington Department of Ecology at least ten business days before any fill placement.

EXH AR019520: Workbook Tools Calculating Soil & Groundwater Cleanup Levels MTCA User’s Guide

This 2001 User's Guide from the Washington State Department of Ecology describes software workbook tools (MTCASGL and MTCATPH) designed to help calculate soil and ground water cleanup levels under the Model Toxics Control Act. The guide covers installation, technical requirements, and step-by-step instructions for entering site-specific data such as chemical properties, exposure parameters, and hydrogeological characteristics. Note that while this document addresses environmental cleanup standards, it does not appear to be directly related to Sea-Tac Airport noise policy.

EXH 2237 (AR 034850): Workbook Tools Calculating Soil & Groundwater Cleanup Levels MTCA — User’s Guide

This 2001 User's Guide from the Washington State Department of Ecology explains how to use spreadsheet workbook tools (MTCASGL and MTCATPH) to calculate soil and groundwater cleanup levels under the Model Toxics Control Act. The guide covers how to enter site-specific data—such as chemical properties, exposure parameters, and hydrogeological characteristics—to determine safe contamination thresholds. It is intended for environmental cleanup professionals working on hazardous substance remediation in Washington State.

EXH AR025055: Email Chain — Acceptable Fill Criteria Language Draft 401 Certification STIA Third Runway

This document is an email chain from June-July 2001 between Washington State Department of Ecology staff discussing acceptable fill material criteria for the Seattle-Tacoma International Airport Third Runway project. Officials debated whether to restrict fill to naturally occurring uncontaminated soils or to allow other materials subject to contamination testing standards, with recommendations including requiring the top six feet of fill to be clean natural soil and using Table 749-3 screening values to protect plants and animals. The discussion also addressed whether the state's Model Toxics Control Act (MTCA) standards should apply, including requirements for contaminant testing, groundwater monitoring, and terrestrial ecological evaluation.

EXH AR023937: Email Chain — Acceptable Fill Criteria Language Draft 401 Certification STIA Third Runway

This 2001 email chain among Washington State Department of Ecology staff discusses recommended criteria for fill material to be used in the Seattle-Tacoma International Airport Third Runway project. Staff member Peter Kmet proposed requiring fill material to meet ecological screening values from Table 749-3, with the uppermost six feet consisting of clean, naturally occurring soil free of manmade organic compounds and metals above natural background levels. The discussion also covers the applicability of the Model Toxics Control Act (MTCA) standards and the need to address potential impacts on plants, animals, groundwater, and aquatic organisms.

Issues

Sea-Tac Airport is currently undergoing the largest and longest expansion in its history, collectively known as the Sustainable Airport Master Plan (SAMP). Some of it you can already hear, but you’re probably not aware of what it all means. Here’s what you need to know.

As the source for federal transportation grants, the Puget Sound Regional Council was charged with developing a system to meet the growing need for commercial aviation. When the search for a second airport failed, they authorized the Port of Seattle to build the Third Runway, with a mandate to develop a noise abatement and mitigation program. In their effort to stop the Third Runway, the ACC argued over every detail of the Port's efforts--including property buyouts and sound insulation. The dispute was meant to be settled by a three member Expert Arbitration Panel. This is their final report. It finds 2-1, that the Port's program was insufficient in several respects. Despite that, funding for the Third Runway was approved by the PSRC, and the 'Port Package' program, proceeded largely unchanged. Expert Arbitration Panel's final decision finding that the Port of Seattle had not shown sufficient reduction in real on-the-ground noise impacts to satisfy noise reduction conditions required for approval of a third runway at Sea-Tac International Airport. The majority decision concluded the Port's noise abatement programs were insufficient despite being impressive in scope.
