Internal email chain dated June 27, 2001 from Peter Kmet (Ecology HQ/TCP) to Kevin Fitzpatrick, cc Chung K. Yee, marked ‘Deliberative Document Currently Exempt From Public Disclosure.’ Kmet recommends language for fill material criteria in the Draft 401 Certification for the Seattle-Tacoma International Airport Third Runway project, including: requiring the uppermost 6 feet of fill to be clean naturally occurring soil with no detectable manmade organic compounds and no metals above natural background concentrations per Ecology publication #94-115; testing fill against Table 749-3 contaminants for terrestrial ecological impacts; bioassay testing per WAC 173-340-7493(3)(b)(i) as an alternative; and statistical compliance methods per WAC 173-340-740(7). Notes MTCA (Model Toxics Control Act) should not govern clean-fill criteria, but if used, all MTCA requirements apply including larger contaminant list, groundwater monitoring, and terrestrial ecological evaluation. Does not address human health exposure pathways or aquatic organism protection.
