Exhibit 2116 AR033733: Email on Sea-Tac Clean Water Act Section 401/402 Split

Internal email from Tom Luster to Kevin Fitzpatrick dated January 12, 2000, discussing the legal distinction between Clean Water Act Section 401(d) and Section 402(a) as applied to Sea-Tac Airport water quality (WQ) and State Environmental Policy Act (SEA/SEPA) policies. Email quotes statutory language verbatim: 401(d) uses mandatory ‘shall’ language for effluent limitations and monitoring

Exhibit 220: Email from Raymond Hellwig to Tom Luster re Des Moines Creek Fish and POS Third Runway Stormwater Review

A January 2000 internal email from EPA's Raymond Hellwig to Tom Luster addresses concerns about premature deaths of Coho salmon in Des Moines Creek near Sea-Tac Airport, in the context of the proposed third runway project. The email clarifies that stormwater discharge regulation will be handled through NPDES permits rather than Section 401 Water Quality Certifications, as the NPDES permit provides the only mechanism for ongoing regulatory oversight under the Clean Water Act. Hellwig directs Luster to defer to the Water Quality Program on stormwater issues and to stop raising the 401 Certification as an alternative avenue for addressing water quality standards.

EXH AR024773: Parametrix Memo — Review of 1999 Annual Stormwater RP, STIA

A September 20, 1999 internal memorandum from Parametrix, Inc. consultants to Scott Tobiason provides technical review comments on the first draft of the 1999 Annual Stormwater Report for Seattle-Tacoma International Airport (STIA). The memo raises concerns about consistency in water quality comparators, statistical methods for 'trimmed' data sets, and the attribution of reduced sediment levels to construction wheel wash versus other factors. It also flags regulatory issues regarding mixing zones, water quality standards language, and potential NPDES permit compliance implications of identifying pollution sources in the annual report.

    EXH 428: Annual Stormwater Monitoring Report STIA Jul 1 1998–Jun 30 1999

This is the Annual Stormwater Monitoring Report for Seattle-Tacoma International Airport, covering the period from July 1, 1998 through June 30, 1999, prepared by the Port of Seattle. The report documents water quality sampling results from airport storm drainage systems, including measurements of petroleum hydrocarbons, metals, fecal coliforms, and the effects of aircraft and ground deicing activities on runoff. It includes data summaries, outfall inspections, and source tracing studies aimed at tracking and managing stormwater pollution from airport operations.

EXH AR024642: Memo Alternative Dilution Modeling Procedures Storm Water Outfalls

A 1999 internal technical memo from Parametrix, Inc. evaluates three alternative water-quality dilution modeling methods for assessing whether proposed stormwater outfalls at the Port of Seattle could exceed Washington State water quality standards. The methods range from a static single-event approach based on Ecology's Permit Writer's Manual to a dynamic continuous simulation using HSPF hydrologic models and a probabilistic EPA-funded model developed by researcher Dominic Di Toro. The memo recommends continuing with the continuous simulation approach while considering budget, Ecology's involvement, and the nature of ambient and effluent pollutant concentration data.

Issues

Sea-Tac Airport is currently undergoing the largest and longest expansion in its history, collectively known as the Sustainable Airport Master Plan (SAMP). Some of it you can already hear, but you’re probably not aware of what it all means. Here’s what you need to know.

As the source for federal transportation grants, the Puget Sound Regional Council was charged with developing a system to meet the growing need for commercial aviation. When the search for a second airport failed, they authorized the Port of Seattle to build the Third Runway, with a mandate to develop a noise abatement and mitigation program. In their effort to stop the Third Runway, the ACC argued over every detail of the Port's efforts--including property buyouts and sound insulation. The dispute was meant to be settled by a three member Expert Arbitration Panel. This is their final report. It finds 2-1, that the Port's program was insufficient in several respects. Despite that, funding for the Third Runway was approved by the PSRC, and the 'Port Package' program, proceeded largely unchanged. Expert Arbitration Panel's final decision finding that the Port of Seattle had not shown sufficient reduction in real on-the-ground noise impacts to satisfy noise reduction conditions required for approval of a third runway at Sea-Tac International Airport. The majority decision concluded the Port's noise abatement programs were insufficient despite being impressive in scope.
