What’s heating up for spring – federal permitting policy update

This May 2026 ESA policy briefing provides an update on federal permitting policy, noting that all three branches of government — legislative, executive, and judicial — are actively shaping permitting decisions. A key highlight is that Trump's second term has seen a dramatically higher number of first-year executive orders than any previous administration in recent history, signaling an aggressive pace of executive action on regulatory and permitting matters. While the document focuses broadly on federal permitting trends, its content is relevant to infrastructure and environmental review processes that can affect airport-related noise and land-use decisions.

When Federal environmental maps go dark

The benefits and consequences for airport communities In January 2025, the Trump administration began removing content from federal websites following Executive Order 14151. The order directed all government agencies to terminate DEI and environmental justice–related programs. These include environmental justice and climate mapping using a nationally consistent dataset for evaluating the socioeconomic impacts of airports.

Letter from San Francisco International Airport to FAA re: Proposed Modifications to Airport Improvement Program Grant Assurances (Docket FAA 2025-0605)

San Francisco International Airport (SFO) submitted formal comments to the FAA on May 9, 2025, opposing proposed changes to Airport Improvement Program (AIP) Grant Assurances, arguing the modifications lack legal clarity and were being rushed into effect mid-fiscal year. SFO raised concerns that incorporating certain presidential Executive Orders into grant conditions is legally problematic, as those orders are directed at federal agencies rather than state or local governments. The airport requested a 30-day comment period extension and asked that any new requirements not take effect before the start of fiscal year 2026.

Airport Improvement Program (AIP) grant assurances

The FAA has proposed updates to its Airport Improvement Program (AIP) grant assurances to reflect new requirements from the FAA Reauthorization Act of 2024 and recent executive orders. Key changes include removing older equity- and climate-related executive orders, adding new ones focused on free speech and ending DEI programs, and introducing a new assurance requiring airports to continue offering leaded aviation fuel (100LL) until a safe unleaded replacement is widely available. Public comments on these changes were accepted through May 9, 2025.

Issues

Sea-Tac Airport is currently undergoing the largest and longest expansion in its history, collectively known as the Sustainable Airport Master Plan (SAMP). Some of it you can already hear, but you’re probably not aware of what it all means. Here’s what you need to know.

As the source for federal transportation grants, the Puget Sound Regional Council was charged with developing a system to meet the growing need for commercial aviation. When the search for a second airport failed, they authorized the Port of Seattle to build the Third Runway, with a mandate to develop a noise abatement and mitigation program. In their effort to stop the Third Runway, the ACC argued over every detail of the Port's efforts--including property buyouts and sound insulation. The dispute was meant to be settled by a three member Expert Arbitration Panel. This is their final report. It finds 2-1, that the Port's program was insufficient in several respects. Despite that, funding for the Third Runway was approved by the PSRC, and the 'Port Package' program, proceeded largely unchanged. Expert Arbitration Panel's final decision finding that the Port of Seattle had not shown sufficient reduction in real on-the-ground noise impacts to satisfy noise reduction conditions required for approval of a third runway at Sea-Tac International Airport. The majority decision concluded the Port's noise abatement programs were insufficient despite being impressive in scope.
