EXH 355: Decl. Dr. Peter Willing Support ACC Motion for Stay (PCHB Nos. 01-133, 01-160)

This document is a legal declaration by Dr. Peter Willing submitted in support of the Airport Communities Coalition's motion for a stay against the Port of Seattle's water quality certification for construction of a third runway at Sea-Tac Airport. Dr. Willing, a water treatment and water quality expert, argues that the Port's plan to augment low summer stream flows using stored stormwater is an unproven concept lacking necessary design details, manufacturer specifications, or documented precedent. He contends that neither the Department of Ecology nor the Pollution Control Hearings Board had sufficient information to evaluate the plan, leaving serious unresolved concerns about potential violations of Washington State water quality standards.

EXH AR021666: Declaration Dr. John Strand Supporting ACC Reply Motion Stay PCHB 01-133 01-160

Dr. John Strand, a fisheries biologist, submitted this declaration to the Washington Pollution Control Hearings Board challenging the state Department of Ecology's water quality certification for Sea-Tac Airport expansion. He argues that stormwater runoff from Seattle-Tacoma International Airport contains copper, lead, and zinc at levels exceeding Washington State Water Quality Criteria, citing the Port of Seattle's own 1995-1996 data showing metals concentrations downstream of airport outfalls far above allowable limits. The declaration was filed in support of the Airport Communities Coalition, representing several cities neighboring the airport, in their motion to stay the certification.

As the source for federal transportation grants, the Puget Sound Regional Council was charged with developing a system to meet the growing need for commercial aviation. When the search for a second airport failed, they authorized the Port of Seattle to build the Third Runway, with a mandate to develop a noise abatement and mitigation program. In their effort to stop the Third Runway, the ACC argued over every detail of the Port's efforts--including property buyouts and sound insulation. The dispute was meant to be settled by a three member Expert Arbitration Panel. This is their final report. It finds 2-1, that the Port's program was insufficient in several respects. Despite that, funding for the Third Runway was approved by the PSRC, and the 'Port Package' program, proceeded largely unchanged. Expert Arbitration Panel's final decision finding that the Port of Seattle had not shown sufficient reduction in real on-the-ground noise impacts to satisfy noise reduction conditions required for approval of a third runway at Sea-Tac International Airport. The majority decision concluded the Port's noise abatement programs were insufficient despite being impressive in scope.
