    In a September 21, 2001 fax to John Drabek, Permit Manager at the Washington State Department of Ecology's Northwest Regional Office, Greg Wingard of Smith & Lowney followed up on a delayed State Public Disclosure Request concerning environmental monitoring data from construction activities at the airport. The letter clarifies that documents requested as far back as June 5, 2001—including upstream/downstream construction monitoring records and turbidity discharge data—had not yet been produced, despite being roughly three months overdue. Wingard requested that the documents be made available no later than September 25, 2001, and offered to pick them up in person to avoid further delay.

    A September 18, 2001 phone call memo from Ann Kenny of the Washington Department of Ecology (WDOE) outlines a legal dispute over the 3rd Runway permit at Sea-Tac Airport, in which the Airport Communities Coalition (ACC) filed a Motion for Stay claiming an imminent environmental threat. WDOE attorneys requested King County provide technical rebuttals to the ACC's expert statements by October 1, 2001, but King County lacked the necessary documents, a contract amendment, and adequate time to respond. WDOE warned it might subpoena County staff if they did not commit to providing the requested support.

As the source for federal transportation grants, the Puget Sound Regional Council was charged with developing a system to meet the growing need for commercial aviation. When the search for a second airport failed, they authorized the Port of Seattle to build the Third Runway, with a mandate to develop a noise abatement and mitigation program. In their effort to stop the Third Runway, the ACC argued over every detail of the Port's efforts--including property buyouts and sound insulation. The dispute was meant to be settled by a three member Expert Arbitration Panel. This is their final report. It finds 2-1, that the Port's program was insufficient in several respects. Despite that, funding for the Third Runway was approved by the PSRC, and the 'Port Package' program, proceeded largely unchanged. Expert Arbitration Panel's final decision finding that the Port of Seattle had not shown sufficient reduction in real on-the-ground noise impacts to satisfy noise reduction conditions required for approval of a third runway at Sea-Tac International Airport. The majority decision concluded the Port's noise abatement programs were insufficient despite being impressive in scope.
