EXH AR023737: Ecology Draft Talking Points — Staff Changes STIA Third Runway 401 WQ Permit Review

In October 2000, Washington State Department of Ecology prepared internal talking points to explain staff changes in the environmental review of the Sea-Tac Airport Third Runway project, including shifting the 401 water quality permit review from Olympia headquarters to the Bellevue regional office and replacing the senior wetlands specialist with an outside consultant. Ecology emphasized that these were routine workforce-management decisions driven by competing project demands, not outside pressure. The agency maintained that its responsibility to ensure the Third Runway met state environmental protection laws — covering stormwater, wetlands, in-stream flow, and clean fill — remained unchanged.

EXH AR023911: Email Luster to Ecology Staff – STIA 401 Certification Requirements & Minority Opinion

In an October 18, 2000 email, Tom Luster of Washington State Department of Ecology shares his draft notes from a discussion about what the Port of Seattle and Ecology must do to meet Section 401 water quality certification requirements related to Sea-Tac Airport. Luster acknowledges that his views represent a minority opinion within the group, but argues his written notes may be clearer than his verbal explanations and could help prepare the agency to respond to similar questions likely to arise during public review. He expresses hope that sharing these notes will help the team reach a legally defensible decision on the 401 certification.

Exhibit 216: Tom Luster Draft Memo on Adequacy of Ecology’s 401 Review for Proposed Sea-Tac Expansion

In October 2000, Washington State Department of Ecology staff member Tom Luster raised concerns about the adequacy of Ecology's Clean Water Act Section 401 certification review for the proposed Sea-Tac Airport expansion. Luster identified multiple unresolved issues, including insufficient stormwater pollution controls, unevaluated wetland and water quality impacts, and conflicts between Ecology's approach and federal Clean Water Act requirements. He warned that failing to address these issues could result in a legally indefensible permit and degraded water quality in nearby creeks and wetlands.

Exhibit 215: Sea-Tac Airport Third Runway 401 Permit Negotiations — Final Draft Meeting Notes, October 13, 2000

These are the official draft meeting notes from October 13, 2000 negotiations between the Port of Seattle, the Washington Department of Ecology, and King County regarding the 401 Water Quality Permit for Sea-Tac Airport's proposed third runway. The meeting covered technical issues including stormwater management, natural resource mitigation planning, and a master list of permit issues tracked by resolution status. Representatives from multiple agencies worked to resolve outstanding questions about detention sizing, wetland hydrology, and environmental compliance requirements.

Exhibit 214: Tom Luster Draft Memo — Sea-Tac 401 Issues List for Ecology Reviewers

A October 9, 2000 internal memo from Tom Luster to Ecology's SeaTac reviewers outlines a draft list of unresolved issues related to the SeaTac Airport 401 water quality certification review. The issues cover stormwater management, streamflows, wetland impacts, and environmental mitigation plans, including concerns about cumulative impacts on Des Moines Creek and Miller Creek from several interconnected proposed projects. The memo notes that some issues may require only minor document clarifications while others may need significant new documentation or development of formal 401 permit conditions.

EXH 241: Preliminary Comments Set 3 on Aug 2000 Stormwater Management Plan STIA Master Plan Update

A September 2000 letter to the Washington State Department of Ecology raises concerns about the Stormwater Management Plan for Seattle-Tacoma International Airport's third runway expansion, arguing it fails to demonstrate compliance with the Governor's Certification requirement to avoid altering water flow between Miller and Des Moines Creeks. The letter also challenges the feasibility of proposed improvements to the airport's Industrial Wastewater System, citing inadequate modeling, unresolved capacity issues, and potential conflicts with FAA safety guidelines regarding wildlife attractants near runways.

EXH 240: Preliminary Comments Set 2 on Aug 2000 STIA Stormwater Management Plan Master Plan Update

This September 2000 letter from environmental reviewers raises concerns about the Seattle-Tacoma International Airport third runway expansion project, specifically arguing that the Port of Seattle's Stormwater Management Plan fails to adequately assess or mitigate reductions in stream base flows and seepage flows to nearby wetlands. The reviewers present hydrological modeling data suggesting that groundwater inputs to Miller Creek could be reduced significantly more than the Port's own estimates indicate, and that the fill embankment's actual drainage behavior contradicts the Port's claims that it would function like natural outwash soil. The letter challenges the Port's assurances that seepage flows to downstream wetlands would be preserved, citing conflicting data within the Port's own documents and questioning the reliability of the analyses used to support those claims.

EXH AR023015: Azous Environmental Sciences Letter to WA Dept of Ecology — Unidentified Tributary Miller Creek Third Runway Docs

A September 2000 letter from environmental consulting firm Azous Environmental Sciences alerts Washington State Department of Ecology officials to an unidentified tributary of Miller Creek that was overlooked in the Port of Seattle's environmental planning documents for Sea-Tac Airport's proposed third runway. The tributary, listed in King County Sensitive Areas records and confirmed to have active water flow, feeds into a Class 2 salmon-bearing stream but was never assessed for potential impacts in the Port's Natural Resource Mitigation Plan. The letter argues this omission—despite four years of environmental analysis—leaves the creek unprotected from planned construction and future aviation operations in the area.

Issues

Sea-Tac Airport is currently undergoing the largest and longest expansion in its history, collectively known as the Sustainable Airport Master Plan (SAMP). Some of it you can already hear, but you’re probably not aware of what it all means. Here’s what you need to know.

As the source for federal transportation grants, the Puget Sound Regional Council was charged with developing a system to meet the growing need for commercial aviation. When the search for a second airport failed, they authorized the Port of Seattle to build the Third Runway, with a mandate to develop a noise abatement and mitigation program. In their effort to stop the Third Runway, the ACC argued over every detail of the Port's efforts--including property buyouts and sound insulation. The dispute was meant to be settled by a three member Expert Arbitration Panel. This is their final report. It finds 2-1, that the Port's program was insufficient in several respects. Despite that, funding for the Third Runway was approved by the PSRC, and the 'Port Package' program, proceeded largely unchanged. Expert Arbitration Panel's final decision finding that the Port of Seattle had not shown sufficient reduction in real on-the-ground noise impacts to satisfy noise reduction conditions required for approval of a third runway at Sea-Tac International Airport. The majority decision concluded the Port's noise abatement programs were insufficient despite being impressive in scope.
