Letter dated December 20, 2001 from Ken S. Berg, Manager, Western Washington Fish and Wildlife Service (Lacey, WA), to James M. Lynch, Esq., Stoel Rives LLP, Seattle, regarding the Monitoring Plan for Embankment Fill Seepage under the Master Plan Update Endangered Species Act Consultation (1-3-00-F-1420). The letter provides 20 numbered comments on the August 10, 2001 monitoring plan, including requirements to address both seepage quality and quantity, initiate monitoring at first seepage occurrence rather than after embankment completion, address groundwater well monitoring pathways, establish collection/treatment/disposal measures if Biological Opinion criteria are exceeded, ensure appropriate analytical detection limits, report exceedances promptly, require FWS approval before plan modifications, and clarify that the Federal Aviation Administration (not the Port) is responsible for reinitiating ESA consultation.
