A 1998 internal email exchange between Washington State environmental officials discusses an urgent regulatory problem that arose during the SeaTac Airport project: stormwater Best Management Practices (BMPs) were found to be inadequate to meet Water Quality Standards, meaning 401 water quality permits could not legally be issued. The Attorney General's office confirmed that 401 permits cannot be granted when stormwater BMPs fail to meet standards at the discharge point, affecting most permit decisions at the time. Officials urged that the issue be added to the agenda of a September 17, 1998 Stormwater Coordination meeting to begin resolving how to handle 401 permits when stormwater concerns arise.

Email from Sandra Manning (Ecology) to Tony Barrett and Tom Luster, cc Terra Hegy, dated September 11, 1998, requesting that 401 permit and stormwater BMP adequacy be added to the agenda for the Stormwater Coordination meeting scheduled September 17, 1998 at the NW Regional Office. Manning explains that the Washington State Attorney General’s office advised that 401 permits cannot be issued if stormwater BMPs are not adequate to meet Water Quality Standards at the discharge point, an issue triggered by the SeaTac project.
