Letter dated April 11, 2001 from Tom Fitzsimmons, Director, Washington State Department of Ecology to Kevin L. Stock, Helsell Fetterman LLP, attorney for the Airport Communities Coalition (ACC), responding to Stock’s March 30, 2001 letter and March 9, 2001 letter regarding Agreed Order #97TC-N122 and the Section 401 water quality certification process for Port Of Seattle’s Third Runway projects. Ecology confirms commitment to host technical meeting on contaminant pathway analysis from the Airport Operations and Maintenance Area (AOMA) to proposed runway sites, declines to hold the 401 certification decision pending completion of ground water study under the Agreed Order (evaluating the intermediate Qva aquifer, contaminant fate and transport, Bow Lake, Des Moines Creek, Miller Creek), and assures ACC that Ecology will not approve or deny the Third Runway projects until the pathway analysis is complete. Also references RCW 70.105D.050(1), MTCA Agreed Order compliance, and an audit of a grant to Port Of Seattle for Agreed Order related work.
