Email chain (AR018498–AR018499) dated July 19, 2001, from Erik Stockdale (likely Washington State Department of Ecology) to Joan Marchioro (ATG) and Andy McMillan, forwarding a message from Jim Kelley of Parametrix, Inc. The judge ruled in favor of Port Of Seattle in the Parcel 92 condemnation case, finding that prior converted croplands were wetlands under local and state regulations (with the exception of Corps regulations), reducing the property value of Parcel 92 located just south of the ‘Vacca Farm.’ Stockdale notes the irony that the Port’s attorneys first disputed regulatory authority over prior converted croplands, then used that same authority to argue for reduced property valuation. A second email discusses mitigation credit ratios (1:1 vs. 0.25:1 vs. 0.5:1) for restoration actions at Lora Lake, including functional benefits such as increased shade, litter, terrestrial insect input, amphibian breeding sites, and water quality from removal of yard maintenance.
