Washington State Department of Ecology Director Tom Fitzsimmons letter dated September 28, 2000 to Port Of Seattle Executive Director M.R. (Mic) Dinsmore regarding Clean Water Act §401 Water Quality Certification and §404 Permit for the Third Runway project at Seattle-Tacoma International Airport. Ecology states insufficient time remains to complete a legally defensible review within the current §401 Certification timeframe and proposes conditions for reapplication: Port must withdraw current application, reapply, and complete public comment period. Issues identified include flow augmentation for Des Moines Creek, protection of Tyee Pond, excavation of Borrow Site #3, Hydraulic Project Approvals from Department of Fish and Wildlife, and deficiencies in the revised Stormwater Management Plan (SMP) affecting Miller Creek, Walker Creek, and Des Moines Creek.
