Email dated April 30, 1999 from Paul W. Cooke (NWS) to Jonathan Freedman, Siri Nelson, and Wanda Gentry (NWS), cc Lester Soule, W. Brett Amrine, and Patrick Cagney (NWS), regarding the Duwamish River Turning Basin #3 Section 1135 habitat restoration project. The email discusses disposing approximately 60,000 cubic yards of excavated material from the Hamm Creek channel construction at a Port Of Seattle 3rd Runway project site, with King County as project sponsor. Two questions are raised: (1) whether using the 3rd Runway disposal site would compromise the Regulatory Branch’s ability to issue an unprejudiced Section 404 permit decision for the Third Runway; and (2) what form of agreement (memorandum of agreement or understanding) should be used between the Corps and Port Of Seattle to authorize the arrangement. Estimated cost savings of $200,000 or more for the Section 1135 project are cited. AR023761.
