Declaration of Greg Wingard (Executive Director, Waste Action Project) filed October 8, 2001, in Environmental Pollution Control Hearings Board cases No. 01-133 and No. 01-160, Airport Communities Coalition v. State of Washington Department of Ecology and Port Of Seattle. Supports ACC’s motion for stay of Section 401 Certification No. 1996-4-02325 (Amended-1) and CZMA concurrency statement issued August 10 and reissued September 21, 2001. Wingard details Public Disclosure Act requests filed June 5, August 13, and September 24, 2001, seeking NPDES construction outfall monitoring records, upstream/downstream monitoring data for Sea-Tac Airport construction phases, and Discharge Monitoring Reports (DMRs) April–August 2001. Ecology could not produce construction outfall monitoring records or upstream/downstream monitoring data; Ecology Water Quality Section Supervisor John Drabek stated records exist but are held by Tom Hubbard at Port Of Seattle. One exception: Walker Creek and/or Gilliam Creek monitoring data provided to Ecology July 2001. Wingard also references NPDES Permit Modification Responsiveness Summary (Fendt Decl., Ex.
