Engagement letter dated November 14, 2025 from attorney Steven M. Taber of Leech Tishman Fuscaldo & Lampl to the Cities of Burien, Des Moines, and SeaTac (collectively the ‘Clients’) following execution of an Interlocal Agreement (ILA). The letter outlines terms for legal representation in filing and prosecuting a Petition for Review in the U.S. Court of Appeals for the Ninth Circuit challenging the FAA’s FONSI/ROD for Port Of Seattle’s Sustainable Airport Master Plan (SAMP). The respondent in the Petition for Review will be the FAA; Port Of Seattle may intervene. Billing rate for Steven Taber is $540/hour; associates bill $300–$400/hour. SeaTac will receive and pay invoices on behalf of all three cities. A $10,000 retainer is required, deposited into a California client trust account. Delinquent amounts bear a service charge of 1.5% per month.
