The Airport Communities Coalition (ACC) — representing the cities of Burien, Des Moines, Federal Way, Normandy Park, and Tukwila, plus the Highline School District — filed a formal appeal in August 2001 challenging Washington State's approval of environmental permits for Seattle-Tacoma International Airport's proposed third runway. The appeal targets the Department of Ecology's Clean Water Act Section 401 Certification and Coastal Zone Management Act concurrency statement, both issued on August 10, 2001. ACC argued that the Port of Seattle's application contained scientific flaws and insufficient information to protect local waterways such as Des Moines Creek and Miller Creek that run through the surrounding communities.

Notice of Appeal filed August 23, 2001, by Airport Communities Coalition (ACC) before the Pollution Control Hearings Board (PCHB) of the State of Washington, Case No. 01-133. ACC appeals the Washington Department of Ecology’s August 10, 2001, issuance of Clean Water Act Section 401 Certification No. 1996-4-02325 and accompanying Coastal Zone Management Act (CZMA) Section 307(c)(3) concurrence statement related to construction of a Third Runway and related projects at Seattle-Tacoma International Airport (STIA). ACC is an interlocal entity composed of the Cities of Burien, Des Moines, Federal Way, Normandy Park, and Tukwila, and the Highline School District.
