Port Of Seattle petition filed August 22, 2002 with the Pollution Control Hearings Board (PCHB No. 01-160) requesting reconsideration of Condition 8 of the Final Order dated August 12, 2002, which prohibited use of the Synthetic Precipitation Leaching Procedure (SPLP) to authorize importation of fill exceeding modified fill criteria. Appellants are Airport Communities Coalition (ACC) and Citizens Against Sea-Tac Expansion (CASE). Port argues that SPLP was integral to formulating fill criteria under MTCA and WAC 173-201A-040(1), that prohibiting SPLP makes it practically impossible to find acceptable fill for the Third Runway project (78% failure rate for uncontaminated soils testing 14 constituents at 90th percentile natural background levels), and that Ecology’s back-calculated criteria for antimony, selenium, silver, and thallium are below actual natural background levels per Exhibit 2126. Port requests SPLP be permitted under additional conditions rather than prohibited outright.
