Port Of Seattle motion filed January 2002 in PCHB No. 01-160 before the Pollution Control Hearings Board for the State of Washington, opposing Airport Communities Coalition (ACC). Port Of Seattle moves to compel ACC to make designated witnesses available for deposition per the Board’s Prehearing Order of October 30, 2001, and to impose CR 34(b) limitations on site visits to Port property. ACC demanded unfettered access for 17 lawyers, client representatives, paralegal, and all ACC witnesses to sample wetlands, streams, stormwater outfalls, embankment areas, and stockpiled fill. Port cites post-September 11 security concerns and seeks to limit site visit to 4-5 named individuals, require specific designation of areas to be visited, require split sampling under agreed protocol, and require ACC to demonstrate routine Ecology sampling data is insufficient before additional sampling is allowed.
