Airport Communities Coalition (ACC) reply brief in PCHB No. 01-160 supporting motion to publish depositions of Ecology managers and CR 30(b)(6) designated witnesses at hearing. Filed March 18, 2002 before the Pollution Control Hearings Board, State of Washington. Argues CR 32 allows depositions of officers, directors, or managing agents of governmental agencies to be used for any purpose at hearing; names Tom Fitzsimmons (Ecology Director), Gordon White (Director Shorelands and Environmental Assistance Program), Ray Hellwig (Director Northwest Regional Office), Ann Kenny (federal permit manager and principal author of the 401 certification), Kevin Fitzpatrick (director Northwest regional office water quality program), Erik Stockdale, John Drabek, and Peter Kmet as deponents. Central issue is whether Ecology had reasonable assurance to issue the Section 401 water quality certification for Port Of Seattle.
