Email chain dated October 3, 2000 from Raymond Hellwig (Ecology) to Thomas Fitzsimmons, Tom Luster, Yvonne Oliva, Kevin Fitzpatrick, Erik Stockdale, Dave Garland, Joan Marchioro (ATG), and others regarding a Public Disclosure Act (PDA) request submitted by Andrea Grad, paralegal at Helsell Fetterman, on September 30, 2000. The PDA request seeks all documents generated or received by Washington State Department of Ecology from Port Of Seattle, its contractors or representatives (e.g., Parametrix), other state agencies, or federal agencies including the Corps of Engineers, since the last PDA request. Request specifically includes documents relating to the Port’s recent withdrawal of its Section 401 application. Hellwig advises that internal deliberative documents need not be disclosed while the Section 401 decision is pending, but external documents (e.g., Tom’s letter to Dinsmore, the Port’s withdrawal document) should be disclosed.
