This Avigation Easement, granted by property owners Robert P. Grants permanent non-exclusive easement for free and unobstructed use of airspace over the Premises for all aircraft types operating to/from Seattle-Tacoma International Airport, unlimited as to frequency and proximity. Base noise level established at 67 DNL per Port’s 1994 FAA-accepted noise contour map; Easement Level not exceeded unless yearly average noise exposure increases more than 1.5 DNL above base level. Executed pursuant to RCW 53.54.030(3). Grantor waives all damages claims incident to aircraft overflights. Burdens run with the land.
