StART – Memo: FAA Authority to Change the 65 DNL
Re: FAA Authority to change the 65 DNL noise contour At a recent StART Aviation Noise Working Group meeting, I shared my professional opinion that it would take Congressional action to change the FAA’s 65 DNL noise contour standard. Below, please find additional details that informed my thinking on this topic. Background 1. First here is a quote from "A Guide to the Rulemaking Process" Prepared by the Office of the Federal Register: "Agencies get their authority to issue regulations from laws (statutes) enacted by Congress. In some cases, the President may delegate existing Presidential authority to an agency. Typically, when Congress passes a law to create an agency, it grants that agency general authority to regulate certain activities within our society. Congress may also pass a law that more specifically directs an agency to solve a particular problem or accomplish a certain goal." 2. There are at least three places where 65 DNL is spelled out specifically in federal regulations and federal orders. These are as follows: 2.1. Code of Federal Regulation (CFR) 14 Part 161. This Federal Aviation Regulation (FAR) describes the process from which any noise abatement rules may be required to show a cost benefit analysis prior to any approval or implementation. The rules dictate that all cost benefit analyses are limited to only the benefits within the 65 DNL contour. Prior to the COVID-19 pandemic, SEA was not only the 8th busiest airport in the country in terms of passenger volumes, but also one of the fastest growing – increasing from 31 million passengers in 2010 to almost 52 million passengers in 2019. This growth – and the associated number of operations and overflights in near-airport communities – has elevated aircraft noise and air emissions as one of the highest community priorities for the Port and the cities of SeaTac, Burien, Des Moines, Normandy Park, Tukwila, and Federal Way. Discussion about planning for a joint StART DC Fly-in. Meeting Summary: I. Facilitator welcome, introduction and meeting agenda, Brian Scott from BDS Planning & Urban Design II. FAA Noise Contour Policy Briefing, Vince Mestre, Consultant o Vince Mestre, co-author of the book ‘A Guide to U.S. Aircraft Noise Regulatory Policy’, introduced the history of 65 DNL, what it represents, and its possible alternatives – as a way to help the working group understand its implications. This presentation greatly helped the working group, particularly related to writing the 2023 FAA Reauthorization Priorities Letter to push the FAA on their next steps. • Origin of 65 DNL § Due to an Air Force base inundated with noise complaints from base housing in the early 1950’s, acousticians developed the first aircraft noise metrics, called the Composite Noise Rating (CNR) with a recommendation to limit base housing noise to less than 100. § 100 CNR equals 65 DNL (Day Night Average Noise Level), making it the origin of 65 DNL published in 1953. § In 1965 HUD was passed by President Johnson.
