Complaint for Disclosure Under the Public Records Act: Steve Edmiston v. Port Of Seattle

Attorney Steve Edmiston filed a lawsuit against the Port of Seattle, alleging it violated Washington's Public Records Act by heavily redacting a consultant's report (the "Ramboll Report") that assessed a 2020 public health study linking Sea-Tac Airport's noise and air pollution to serious health harms in nearby communities, including lower life expectancy and higher rates of heart disease and premature births. The Ramboll Report, commissioned by the Port days after the public health study was released and shared with the Port's CEO, was intended to evaluate the study's findings and recommendations. Edmiston is seeking court-ordered disclosure of the unredacted documents, along with attorney fees and penalties to deter future violations.

Notes

Pro se complaint filed by plaintiff Steve Edmiston against Port Of Seattle in King County Superior Court under Washington Public Records Act (PRA), Chapter 42.56 RCW, seeking non-redacted disclosure of the Ramboll Report — a 28-page consultant report commissioned by the Port days after the December 1, 2020 Seattle-King County Public Health report (HB 1109) on Sea-Tac Airport noise and air pollution health impacts. Requests at issue are #21-208 and #21-299. The Ramboll Report reviewed the Public Health Report and generated findings and recommendations on study methods and results; Port redacted all meaningful content from every copy. Plaintiff seeks disclosure, attorney fees, and penalties under RCW 42.56.550. Health outcomes documented include lower life expectancy, higher death rates from heart disease, chronic lower respiratory disease, diabetes, chronic liver disease, higher hospitalization rates, and higher premature birth rates in communities near Sea-Tac Airport.
