A letter from Helsell Fetterman law firm on behalf of the Airport Communities Coalition (ACC) to the U.S. Army Corps of Engineers and Washington Department of Ecology, urging denial of the Port of Seattle’s Clean Water Act Section 401 certification and Section 404 permit for the proposed Third Runway at Sea-Tac Airport. The letter argues that the Port’s application is technically deficient, that its engineered stormwater solutions are inadequate, and that the Port is proceeding with construction despite pending regulatory decisions. The ACC contends that the project fails both the 401 reasonable assurance standard and the 404 public interest review.
