Letter to Department of Ecology Regarding Lack of Enforcement of Agreed Order #97TC-N122 and 401 Certification

The Airport Communities Coalition (ACC), represented by Helsell Fetterman law firm, writes to the Washington Department of Ecology objecting to the Port of Seattle’s failure to comply with the May 25, 1999 Agreed Order requiring groundwater studies and fate-and-transport modeling at Sea-Tac Airport. The letter requests immediate enforcement action against the Port, a state audit of Ecology grant funds spent by the Port, and a hold on the Port’s 401 Clean Water Act certification until compliance is achieved. ACC argues that without the required groundwater study, Ecology cannot provide reasonable assurance that the third runway project will not violate state water quality standards in Miller Creek, Walker Creek, and nearby drinking water supplies.
