Port Of Seattle’s motion for partial summary judgment on SEPA issue

Notes

The Port of Seattle filed a motion for partial summary judgment before the Pollution Control Hearings Board seeking dismissal of Agreed Issue No. 14 regarding SEPA compliance. The Port argues the Board lacks jurisdiction to hear the Airport Communities Coalition’s claims that environmental impact statements for the Master Plan Update were legally inadequate and that a supplemental EIS should be required. Six independent grounds for dismissal are presented, including prior litigation, categorical exemptions, and lack of appealable SEPA decisions in Ecology’s 401 Certification.
