The Port of Seattle, owner and operator of Seattle – Tacoma International Airport (“Sea-Tac”), agrees that proceeds generated from taxes on aviation fuel should only be used for aviation-related purposes. However, some airports, including Sea-Tac, lack the authority to impose or collect taxes on aviation fuel. The proposed clarification would require those airports to provide assurances on a matter over which only the state or other jurisdiction has control. The clarification should be revised to exempt from the assurance requirement those airports that lack authority to levy or collect taxes on aviation fuel.
