The Airport Communities Coalition (ACC), composed of the Cities of Burien, Des Moines, Federal Way, Normandy Park, and Tukwila, and the Highline School District, filed this notice of appeal with the Pollution Control Hearings Board challenging the Washington Department of Ecology’s June 7, 2004 issuance of Clean Water Act Section 401 Certification No. 1996-4-02325 (Amended-2) to the Port of Seattle. The appeal concerns the Third Runway Project at Seattle-Tacoma International Airport, alleging the 2004 Certification fails to comply with the Washington Supreme Court’s mandate, the Clean Water Act, and applicable water quality laws. The ACC argues that contaminated fill materials are planned for use in the project, threatening the water quality of nearby streams and wetlands.
