Agreement between Hill Grove Cemetery Association, a Washington non-profit corporation, and Port Of Seattle, a Washington municipal corporation, for tree removal and permanent easement conveyance on cemetery property in King County, Washington. Port’s Flight Corridor Safety Program requires removal of six trees identified as flight surface obstructions near Seattle-Tacoma International Airport, with Port invoking eminent domain authority absent voluntary agreement. Agreement covers license for entry, liability and indemnification under RCW 4.24.115 and Title 51 RCW Industrial Insurance, permanent easement (Exhibit C) to be recorded with King County Recorder’s Office, Real Estate Excise Tax Affidavit (REETA), tree removal methods, stump treatment, site restoration per Replacement Vegetation Schedule (Exhibit D), and installation of up to 250 linear feet of vinyl-coated chain link fence with ornamental gate reading ‘Hillgrove Cemetery’ along S. 200th Street within 12 months of Effective Date.
