The Pollution Control Hearings Board issued this second pre-hearing order in the appeal by the Airport Communities Coalition against the Washington Department of Ecology and Port of Seattle. The order accepts 21 stipulated legal issues and adds a 22nd issue regarding whether Ecology had reasonable assurance that Section 401 and applicable water quality laws would not be violated when relying on a stormwater detention system potentially subject to dam safety regulations. The order also schedules a site visit for March 1, 2002, to view areas related to the third runway expansion, associated mitigation areas, and surrounding streams and wetlands.
