My name is Elizabeth Clark. I am submitting this testimony to describe for the Board, the fill acceptance process implemented by the Port under the 1998 and 1999 Fill Acceptance Agreements and, more recently, relative to the fill acceptance criteria contained in the September 21, 2001 Ecology 401 Certification and the May 22, 2001 U.S. Fish & Wildlife Service (FWS) Biological Opinion (collectively, the Current Fill Acceptance Criteria). In this testimony I provide: (1) an overview of the process used to review fill under the 1998 and 1999 Fill Acceptance Agreements; (2) a description of fill accepted under the 1998 and 1999 Fill Acceptance Agreements for which ACC has voiced specific concerns; (3) an overview of the process the Port is using to review fill under the Current Fill Acceptance criteria; and (4) a discussion of the fill sources accepted…
