This will havean appeal period, and is likely to be appealedby th_ ACC with similarclaims. • The ACC has statementsfrom numeroustechnicalexpertssupportingtheirposition for Appeal and Stay, This includesNI-IC,P_er Willig (sp?), Amanda Azous,Tom Luster, etc. • The contractamendmentto cover the recentlycompletedwork,and to extend hours to coverfuture support is not in place. Apparentlythere is agreementby PO8 to OKthis amendment. • WDOE attorneys,Tom YoungandJeanne Marehiotti (spT),have indicated they want King County to providethe rebuttal to the statementsby the ACC technicalexperts, The workproductrexFmstedhas notbeen well described,but may include are,quest for theCountyto provideavidavits that theACC technicalissues arewithoutmerit. This workis to be completedby October I, 2001. • King County does not havecopies of the appeal documents, nor the statementsby the ACC'stechnical experts. King Cotmty technicalstaff has notspenttime reviewing the CtLrrentpermit conditions,and is totallyunawareof recent agreementsbetweenWDOEand POS. • King Countydoes not havea contractamendment in place to cover this additional workrequest. • King Countyindicated thatreview staff is bettersuited in answeringspecific WDOE technicalquestions _ they relate to our letterof concurrenceon the StormwaterManagement Plan, and . comment letter on the separate LowFlow AugmentationPlan.
